If Jetpak AB is prevented from fulfilling the terms of the agreement by circumstances beyond its control, which Jetpak could not reasonably have been expected to foresee on entering into the agreement and whose consequences Jetpak could not reasonably have avoided or overcome, such as:
- strike or industrial stoppage by a third party
- war
- natural disaster
- national state of emergency
- measures taken by a national government, or the like,
this, if it affects the proper performance of the agreement, shall represent grounds for exemption from liability to fulfil the agreement, shall defer performance of the undertakings to a later date, and shall entail exemption from a fine or other sanction.
If fulfilment of the agreement has been substantially prevented for a period longer than six (6) months by any one or more of the above circumstances, a party (JP) shall be entitled to waive the agreement in writing without thereby entailing liability for compensation or damage.
